COLUMBIA TOWNSHIP, HAMILTON COUNTY, OHIO


ESTABLISHING A PERMIT REQUIREMENT FOR EXCAVATION IN A COLUMBIA TOWNSHIP ROADWAY OR CONSTRUCTION WITHIN THE COLUMBIA TOWNSHIP RIGHT-OF-WAY; ESTABLISHING A PERMIT FEE; AND ADOPTING RULES AND REGULATIONS FOR EXCAVATION AND CONSTRUCTION

WHEREAS, the Board of Trustees of Columbia Township has deemed it in the best interests of the Township to require any person, firm, corporation or utility company to obtain a permit before making any excavation in a Columbia Township roadway or undertaking any construction within the Columbia Township right-of-way; and

WHEREAS, Ohio Revised Code §5571.16 permits a board of township trustees authority to require such a permit and the payment of a permit fee to the Township, along with the following conditions:

(A) Require the applicant to submit plans indicating the location, size, type and duration of the excavation or construction contemplated;
(B) Specify methods of construction or excavation, refilling and resurfacing to be followed;
(C) Require the use of such warning devices as it deems necessary to protect travelers on the roadway;
(D) Require the applicant to indemnify the township against liability or damage as the result of such excavation or construction;
(E) Require the applicant to post a deposit or bond, with sureties to the satisfaction of the board, conditioned upon the performance of all conditions to such work; and

WHEREAS, the Board of Trustees further deems it in the best interests of the Township to adopt rules and regulations guiding excavation and construction in the roadways and rights-of-way in Columbia Township;

NOW, THEREFORE, BE IT RESOLVED, the Board of Trustees of Columbia Township, Hamilton County, Ohio, for the benefit and welfare of Columbia Township and its citizens hereby establishes a permit requirement for excavation in a Columbia Township roadway and construction within the Columbia Township right-of-way; establishes a permit fee of $2.00, as authorized by the Ohio Revised Code; and adopts by reference the RULES AND REGULATION OF THE OFFICE OF THE COUNTY ENGINEER GOVERNING DRIVEWAY REGULATIONS AND PAVEMENT AND/OR RIGHT-OF-WAY OPENING PROVISIONS FOR THE UNINCORPORATED AREA OF HAMILTON COUNTY, a copy of which is on file at the Columbia Township Office or at the Office of the County Engineer, for excavation and construction in roadways and rights-of-way in Columbia Township.
